Is there another chair you can wheel over to the new guy and ask him then for your chair to be returned?
Worse case scenario he says he also has a bad back and asks for it himself in which case tell him to explain this to his team leader and he will soon have be a similar chair of his own.

Somebody nicked my chair at work once, I came back from lunch to find some cunts had stolen all the office chairs for their meeting. So... I interrupted the meeting with "Excuse me, but I'd like my chair back". I got a chair back, but it wasn't mine.
Still rankles to this day.*

Along similar lines, we had an email at work today about a scheme to support BAMEs, women and staff with disabilities to progress into more senior roles. Someone has replied cc'ing the entire organisation with "this will cause a lot of unhappiness amongst non-disabled white men. Why do we not get the same opportunities?" I am eagerly awaiting the fallout
